GENERAL TERMS OF USE OF THE ELECTRONIC SERVICES OF  THE INFORMATION PLATFORM FOR SEPARATE COLLECTION AND RECYCLING OF WASTE IN THE MUNICIPALITIES OF SMOLYAN AND BANITE

The information system is a project of the Municipal Administrations, project partners, with correspondence address: Smolyan, Blvd. “Bulgaria” No. 12.

These GENERAL TERMS and CONDITIONS govern the relationship between the Municipal Administrations, partners in the project, on the one hand, and any person (hereinafter referred to as USER for short) who uses the websites of the Municipal Administrations, partners in the project, and/or the services, provided through them.

In connection with the use of personal information voluntarily provided by users, the Municipal Administrations, partners in the project, are registered with the Commission for the Protection of Personal Data.

1. TERMS OF SERVICE

Municipal administrations, project partners, provide USERS with the following services:

- access to information via the Internet,

- registration and subscription to the periodicals of the Municipal Administrations, project partners.

Municipal administrations, project partners, provide the SERVICES under the following CONDITIONS:

- THE CONDITIONS may be updated at any time without special notification to USERS, as the Municipal Administrations, project partners, undertake to publish the changes on their page at: smolyanwaste.eu

Municipal administrations, project partners, are not responsible if the USER has not read the latest version of these TERMS.

When using the SERVICES of the Municipal Administrations, project partners, the user undertakes to comply with these TERMS, as well as all other conditions set by the legislation of the Republic of Bulgaria and international legislation, even if they are not mentioned in this USER AGREEMENT.< /p>

THE USER AGREES TO THE TERMS OF USE OF THE SERVICES OF THE MUNICIPAL ADMINISTRATIONS, PROJECT PARTNERS, BY PRESSING THE "I AGREE" BUTTON. AND IS DEEMED TO HAVE READ, ACCEPTED AND BOUND TO BE BOUND BY THE USER AGREEMENT.

2. DESCRIPTION OF SERVICES

USER understands and accepts that the SERVICES are provided "as is" and that the Municipal Administrations, partners in the project, does not assume any responsibility for the timeliness, deletion, inability to deliver or save personal settings or communications of the user, as well as for damages, lost benefits and other damages that occur after, as a result of or due to use (or inability to use due to technical problems, prevention, administrator decisions, etc.) of the SERVICES.

To use the SERVICES, the USER must access the World Wide Web directly or through other devices that can access web-based content. In addition, the USER must provide all necessary equipment to access the World Wide Web, including a computer, modem or other means of accessing the Internet network. The municipal administrations, partners in the project, only provide the SERVICES and are not responsible for any interference or technical problems preventing the use of the SERVICES due to the computer equipment operated by the USER.

3. USER OBLIGATIONS WHEN REGISTERING

Given the use of the SERVICES of the Municipal Administrations, project partners, the USER undertakes:

a) to provide true, accurate, up-to-date and complete information about himself and the represented organization in agreement with the relevant responsible person when filling out the registration form with the name PERSONAL DATA, INVOICE DATA, MY PROFILE and/or COMPANY PROFILE;

b) to make changes to his/her profile in the MY PROFILE and/or COMPANY PROFILE sections, as needed, with a view to their fidelity, accuracy, relevance and completeness.

In the event that the USER provides false, inaccurate, out-of-date or incomplete information, the Municipal Administrations, project partners, have the right to close and/or delete the information at/about his address and deny him further access to a part or to all its SERVICES.

4. PROTECTION OF PERSONAL DATA. PRIVACY POLICY

Municipal administrations, partners in the project, is registered as a personal data administrator and collects and processes the personal data provided by its customers, according to the conditions stipulated by the Law on the Protection of Personal Data in force from 01.01.2002. data is used to analyze added waste and to contact the user in case of problems related to the containers.

Personal data will not be provided in any form to persons other than those mentioned above or used for purposes other than those described above. Each client's personal data is kept for one year and can be deleted from our database at any time if the client wishes.

According to the Law on the Protection of Personal Data in force from 01.01.2002, the USER has the right of access to his own PERSONAL DATA, which he has entered or has become known to the Municipal Administrations, project partners, when he uses the THE SERVICES, as well as the correction of this DATA,

All DATA voluntarily provided by the USER and other DATA that identifies him in the process of using the SERVICES are stored, processed and used by the Municipal Administrations, project partners, for the purpose of maintaining certain functionalities of the SERVICE.

Municipal administrations, project partners, expressly informs the USER that there are no persons who can receive the USER'S PERSONAL DATA for advertising purposes, without the USER's consent.

Municipal administrations, partners in the project, reserves the right to use the IP addresses of the USERS to reveal their identity in cases where this is necessary in the implementation of the law, legal procedures or to comply with these conditions.

Users' personal correspondence is strictly confidential and will not be disturbed, altered or read without the express consent and/or direction of the USER.

5. ACCESS, USERNAME, PASSWORD and SECURITY

The USER receives the desired USERNAME and PASSWORD and access to all SERVICES of the Municipal Administrations, project partners, after completing the registration and payment process when choosing paid access.

The USER is responsible for maintaining the confidentiality of the USERNAME and PASSWORD created and is fully responsible for all activities accessed under his USERNAME and PASSWORD.

The USER undertakes to immediately notify the Municipal Administrations, project partners, of any unauthorized use of their USERNAME and PASSWORD or of any other breach of security, as well as to terminate access to the SERVICES ("Exit" at the end of every session.

In the event of losing (forgetting) the USERNAME and/or PASSWORD, the Municipal Administrations, partners in the project, will automatically generate new ones at the email specified by the USER.

Municipal administrations, partners in the project, are not responsible for any damages and losses that occur due to non-compliance with the provisions of this point.

6. USER BEHAVIOR

The USER agrees to notify him of any errors, technical problems and other problems he has noticed, related to the use of the SERVICES, by sending an electronic message to the address smolyan_municipality@abv.bg

7. OTHER

Municipal administrations, project partners, have the right to change the technology, design and concept of the SERVICES provided without prior notice.

Municipal administrations, project partners, reserve the right to send system messages to their users related to new SERVICES or changes in the TERMS and methods of using the current SERVICES.

Municipal administrations, project partners, reserve the right to delete a USERNAME created by the USER if the latter is not used for 12 months and there are no active services.

Given the international nature of the Internet network and that the Project Partner Municipal Administrations are connected to this network, the Project Partner Municipal Administrations do not guarantee that the flow of information to and from the Project Partner Municipal Administrations will not be tracked and recorded by third parties.
